La’Quetta Small is currently under criminal  indictment for 2nd Degree Endangering the Welfare of a Child.

Her criminal trial is set for December 1, 2025.

How Can La’Quetta Small Still Be Allowed To Serve As Atlantic City Public Schools Superintendent?

The Atlantic County Prosecutor’s Office previously released the following narrative about Marty and La’Quetta Small. The allegations are deeply disturbing in nature:

On Tuesday, September 17, 2024, Marty Small, Sr., 50, and his wife, La Quetta Small, 47, of Atlantic City, NJ were both indicted for second-degree Endangering the Welfare of a Child. Marty Small, Sr. was also indicted for third-degree Terroristic Threats, and third-degree Aggravated Assault. It is alleged that during the months of December 2023 and January 2024, the defendants physically and emotionally abused their 15/16-year-old-daughter on multiple occasions. During one incident, on January 13, 2024, Marty Small, Sr. is alleged to have hit his daughter multiple times in the head with a broom causing her to lose consciousness, said the Atlantic County Prosecutor's Office.

New Jersey Law When A Public Schools Employee Is Criminally Charged With Child Abuse

New Jersey law (N.J.S.A. 18A:6-7.1) requires that when charges are pending for a crime that would be a disqualifier upon conviction, a school employee is ineligible for employment until the case is resolved. For child abuse, this means:

The individual will be removed from their position pending the outcome of the case. Once the legal process concludes and a determination is made, the employee's eligibility for continued employment will be re-evaluated.

Permanent Disqualification Upon Conviction

A conviction for child abuse or related offenses will result in permanent disqualification from working in a New Jersey public school. New Jersey law states that a person is permanently barred from employment if a criminal history record check reveals a conviction for:

 

  • A crime of the first or second degree.
  • An offense involving endangering the welfare of children.
  • A "substantially equivalent" crime committed in another state.

Atlantic City Board of Education & State of New Jersey — Shame on You

Why have you allowed an individual who is criminally indicted for child abuse to remain in office as the superintendent of public schools for Atlantic City question?

The law here is plain and simple, and yet both the Atlantic City Board of Education, and the state of New Jersey are willfully ignoring it.
