The criminal trials of Atlantic City, New Jersey Mayor Marty Small and his Schools Boss wife have been delayed, again.

Marty and La’Quetta Small Will Have Separate Criminal Trials

The original intent was to try their cases together in one trial … however, La’Quetta Small petitioned New Jersey Superior Court Judge Bernard DeLury to separate herself from her husband.

Judge DeLury appropriately granted La’Quetta Small’s motion for a separate trial.

La’Quetta Faces A One Count Indictment

An Atlantic County Grand Jury indicted La’Quetta Small more than a year ago on a serious 2nd Degree Endangering The Welfare of a Child criminal charge.

If La’Quetta Small is convicted, she will never be able to work in a public school in New Jersey ever again.

New Jersey law calls for her to be suspended, pending the disposition of her criminal case. Yet, miraculously, the state of New Jersey has allowed her to continue to work in her position.

On Tuesday, September 17, 2024, Marty Small, Sr., (then) 50, and his wife, La Quetta Small, (then) 47, of Atlantic City, NJ were both indicted for second-degree Endangering the Welfare of a Child. Marty Small, Sr. was also indicted for third-degree Terroristic Threats, and third-degree Aggravated Assault. It is alleged that during the months of December 2023 and January 2024, the defendants physically and emotionally abused their 15/16-year-old-daughter on multiple occasions. During one incident, on January 13, 2024, Marty Small, Sr. is alleged to have hit his daughter multiple times in the head with a broom causing her to lose consciousness, said the Atlantic County Prosecutor's Office.

New Jersey Superior Court Judge Bernard DeLury Will Not Try The Cases

Judge DeLury has retired. He will be missed.

Judge DeLury has done a fabulous job for more than a year … hearing a number of motions and shepherding the three criminal cases, so that they are ready to go to trial.

  • La’Quetta Small
  • Constance Days-Chapman, suspended Principal of Atlantic City High School.

Interesting to note, many trial dates have been assigned to Marty and Laqueta small. Not a single trial date has ever been assigned.for Days-Chapman.

Perhaps this means that the state is hoping that Days-Chapman Will agree to testify against Marty and La’Quetta.

To date, there has not been any discernible movement that would indicate that Days-Chapman will turn on her two close friends.

However, Days-Chapman Is In Significant Jeopardy

An Atlantic County Grand Jury indicted Days-Chapman on August 17, 2024 on a variety of criminal counts as follows:

  • second-degree Official
    Misconduct.
  • one count of second-degree Pattern of Official Misconduct.
  • one count of second-degree Endangering the Welfare of a Child.
  • one count of third-degree Hindering
    Apprehension of Another.

The New Trial Court Judge Will Be …

New Jersey Superior Court Judge Joe Levin.

Levin is an accomplished jurist and he is a no-nonsense judge.

Levin will do a great on these 2 or 3 criminal cases, because I still think there is a good chance that Days-Chapman Will not go down on The Small Ship.

Monday, January 12, 2026.
